A Right Leaning SCOTUS — The Legacy Of Bush 43
With the demise of the Immigration bill that even the Bush/Kennedy/McCain & Co. alliance could not get passed in the Senate, along with the failure last year to achieve Social Security reform and the barrage of bad news on Iraq by the MSM, it seems like every other site or blog that you run into is decrying what surely will be the failed legacy of the Bush-43 Presidency. The Conservative base — never happy with No Child Left Behind, faith-based initiatives and out-of-control Federal spending from both Republican and Democrat Congresses alike plus apparent Bush mis-steps like appointing Harriet Miers for the SCOTUS — is lack-luster in its support for the current crop of announced ’08 GOP POTUS candidates, with more than the occasional jabber about “sitting out this one”. That would be a major cryin’ shame, as the true legacy of Bush 43 became clear last week with this term’s final SCOTUS rulings. Elections count, and the ones of 2000 and 2004 were giants in regards to the future direction of our country!
On topics as diverse as abortion, race, free speech, the separation of church and state, and the death penalty, the court ruled mostly via 5/4 decisions, with Justice Kennedy most often being the swing vote. NPR hails these as “landmark rulings”, the Leftist site All American Patriots was even more distressed. As Patterico notes, the LA Times David Savage went apoplectic about it all over the weekend, and if you peruse the MSM outlets you’ll come to understand that the Liberal press hates this court — which makes it seem pretty sweet to me.
I’m not a legal-minded observer and I’m not a SCOTUS junky, but I enjoy seeing some sanity returned to the abortion debate with the 3rd trimester partial birth abortion ban upheld, and with seeing the words “The way to stop discrimination on the basis of race is to stop discriminating on the basis of race,” written by Chief Justice John G. Roberts Jr. in the court’s knock-down of two race-based solutions for maintaining or reapportioning integration of public schools. I don’t believe that a viable human fetus should be killed — there’s always a better way — and it’s about time that race became transparent in decisions regarding public schooling.
The decision that I and several of my clients liked a lot was the strike down of the 96 year-old minimum-price-control ban that has hobbled manufacturers of goods ever since. I’ve seen first hand how internet whores especially can literally destroy brand equity virtually overnight, by selling at deep discounts or even at a loss, just to gain market share. With the ability to set basement level pricing, instead of just MAP (minimum advertised prices), those that want to have sufficient margins to cover the costs of excellent customer service will be able to compete with the bare-bones retailers and the internet sellers.
Dennis Prager has often commented on the immorality of shoppers that went into full-service brick-&-mortar stores to try out products and get the help of knowledgeable salespersons, only to then go home, shop deep on the web and buy on the cheap. This decision will help those retailers that wish to rely on service and reputation to drive their business models. But, bargain shoppers, there will always be cheaper good, less expensive brands. We just won’t be able to get those Tommy Bahammas at Macy’s for $38 anymore!
Bush is at home in his own skin, as Laer presents to us so well. I think that he has a few more interesting surprises up his sleeves, (look at what he did today!), and I wouldn’t be at all surprised if he works a bit o’ magic on the Iraq situation. But, if all he does is fight off subpoenas and side steps the nutter’s calls for impeachment for the next 18 months, his legacy is set with the Supreme Court that exists today. If he is fortunate to nominate and get confirmed one more justice, the legacy of George W. Bush will extend deep into the 21st Century without a doubt. Sorry nutters — we win, you lose!
