SCOTUS — D.C. Circuit Court Justice Roberts Nominated

D.C. Circuit Court of Appeals Justice John G. Roberts, Jr. has been nominated by President George Bush as the replacement for the retiring Justice Sandra Day O’Connell. According to RedState.org:

  • Judge Roberts and the President know each other the President is “comfortable” with him.
  • The judge sits on the U.S. Court of Appeals for the D.C. Circuit and is therefore very familiar with a host of government related issues that will soon be heading toward the Supreme Court.
  • Importantly for this White House, Judge Roberts is seen as jurist willing to extend the Executive Branch wide flexibility in both its conduct of general official business and the War on Terror.
  • The Vice President seems favorable to Judge Roberts given Roberts’s propensity to give the Executive Branch some flexibility (Judge Roberts participated in the In re: Cheney decision, which struck a blow to the environmentalists seeking a list of participants in energy task force meetings).
  • Judge Roberts is one of the few judges most likely to be very controversial to left wing groups, but be seen as a quality judge by both the public and the seven Democrats who signed the filibuster deal.

That last point seems to be the important one. Bush needs a win and as Bill Kristol has just said on Fox News, “this is a bold pick”. That should give him one. Born in 1955, Roberts is young, which will give him influence over the Court’s decisions for decades.

He had unanimous confirmation during his 2003 Appeals Court Senate confirmation. I doubt that he will fare that well this time — the Left has lost its mind don’t you know — but he should be confirmed. OK boys & girls, time to take off the gloves! (db)

[Update] The Mooreites and Deaniacs are already stressing. Senator Orin Hatch of the Judiciary Committee said on Hanity & Colmes that the American people “aren’t going to put up with anymore of that crap!” I certainly hope that is so . . . (db)

    We the American people have been unwilling to put up with anymore crap from the Left for quite some time, as demonstrated last November. Is the Senate majority ready to dispense with the crap from both Democrats and RINO’s alike and get the job done? This man is too good to have his professional existence trashed for political expedience. What will become of mankind,if we continue to let good men be crucified?
