SCOTUS — The Battle is Moving Fast!

Check into Kos and you can see the turmoil generated by the retirement announcement of Supreme Court Justice Sandra Day O’Connell. One of, if not the biggest, point of alarm for the Libs is their terror over the upcoming possibility that they someday might not have the legal right to exterminate the lives of their unborn children. The Right to Choose [Death] is the linchpin of the progressives’ religion. Some quotes from the various articles on the issue:

“Alberto “the Inquisitor” Gonzales is a possibility… what could possibly be worse?”

“This [abortion] is perhaps the MOST IMPORTANT reason why the SCOTUS is extraordinary. But there are many others. Affirmative action. Church-state separation. Environmental laws.”

“Of course the condoning of torture marks Gonzales as morally reprehensible.

But, even if one is only going to look at this cynically, Gonzales can not be trusted. We THINK he is a moderate. We THINK he’ll support the right to choose. We THINK he’ll support affirmative action.

But how do we know? What has Gonzales done to earn the belief that he won’t be a patsy in the hands of a Scalia?

Nothing as far as I’m concerned. Indeed the opposite is true.”

Bipartisan consultation in fact has a long history, and Bush should follow Hatch’s wise example. In particular, Bush should discuss the matter with Harry Reid, who has already made several worthy suggestions. America will be much better off with a consensus candidate who garners widespread support both in the Senate and among the public.

I can’t disagree with everything that is said there, for example:

Whatever happens with the Supreme Court nomination battle that is about to ensue, it’s going to happen fast.

Taking a “Right” turn around the blogosphere, Michelle Malkin has a departing post for Justice O’Connell, plus a plethora of links. [Yeah, the Okie said "plethora".]

The Anchoress posts that the Democrats in the Senate will never give Bush’s upcoming nominees the consideration that Republicans extended to Ruth Bader Ginsberg during her confirmation hearings.

Doug TenNapel puts the upcoming conflict this way:

The problem is not pro-abortion or pro-life. The battle is not pro gay-marriage or anti. The battle is between “Strict Constructionist” and the “Living Breathing Document” crowd.

Paul Mirengoff at Powerline goes against the general thoughts floating around, but sure makes a lot of sense when we writes:

The key right now is to make sure that we get one conservative out of the Bush administration (even his father accomplished that). To maximize our chances, the first nominee needs to be conservative regardless of the political orientation and gender of the retiring Justice.

Captain Ed Morrissey pretty much says it all:

All I know is that O’Connor’s resignation finally unleashes the political forces that both sides have stoked since the election. We’ll see how the Senate MOU and the Gang of 14 have affected the process in short order now. Pass the popcorn, folks … it should be a hell of a show.
