I am confused. The DU is snickering about hoodwinking the Republicans. But, when you read what President Bush said about Judge Owen (in conjunction with the republican&#039;s majority in the Senate) is appears to be a huge loss for the democrats. In fact, Owen appears to be, for all intense purprises, on the bench. 
&quot;Judge Owen is finally going to get an up or down vote on the Senate floor. She is my friend, and more importantly, she&#039;s a great judge. I want to thank the Texas Senators who have been so strong, standing beside Priscilla. There was never any doubt in the Senators&#039; minds that Priscilla Owen is well-qualified to honorably serve on the federal bench. And it&#039;s such a -- it&#039;s a great day for our friend, to see our friend finally get a just due, after a long, long wait. So, welcome and congratulations...&quot; - President Bush

As far as I can tell the &quot;Constitutional Option&quot; is still armed and use able. The democrats have just given a few inches to a few judges and nothing more.
The only thing I can say is that the &quot;back-down&quot; of the democrats is just a stall tactic - designed to give them more leverage once their &quot;press&quot; friends smear Bush&#039;s judges. Then it will be back to the filibuster.
I may be wrong. If any of you have a concise explanation as to exactly the nature of the &quot;agreement&quot; I would like to hear it.</description>
