18 Senators Vote to Filibuster Owen

What else would you expect. Capt. Ed list the 17 Democrats that voted to not allow an up-or-down vote for justice Priscilla Owen. There were enough votes to force cloture, and her vote before the full Senate is assured, but come on, these Dems are down, dirty and determined. Look at what Senator Reid said today about the compromise:

“The agreement that will allow Justice Owen to receive an up-or-down vote also had the effect of taking the nuclear option off the table,” he said, referring to Frist’s threat to strip Democrats of their ability to filibuster. “This agreement makes clear that the Senate rules have not changed. The filibuster remains available to the Senate minority.”

The lunatic fringe, as represented by the DNC chair Howard Dean, isn’t sure if the “deal” will be good for the donkey party or not.

Democratic Party Chairman Howard Dean, in an interview with The Associated Press, said, “I would be hesitant to say it’s a win for the Democratic Party.” That won’t become clear, he added, until “we find out if the president consults with the Democrats” on future judicial nominees.

Dean said the deal “was a huge loss for the right wing. … It was clearly a loss for the president because he was getting accustomed to ramming things through the House and the Senate without any confrontation. It was a win for America because minority rights were supported.”

Without confrontation? Ten judges filibustered is not being confrontational? Insane. And if Howard thinks that George Bush is going to go hat in hand to Congress to pre-evaluate his judicial nominations to the Appellate and Supreme courts, he’s been drinking way to much of whatever was left on the party bus after Terry McAuliffe left.

Michelle Malkin has quite a wrap-up of links, and Confirm Them discusses majority leader Frist’s statement that the “deal” will make judicial nominee filibusters almost impossible, and makes clear that Senate Republicans still have the “out option” if a filibuster is used for anything but “extraordinary circumstances”.

Obviously, what this all means is that absolutely NOTHING HAS BEEN RESOLVED! The Dems will filibuster when they wish, although they will probably hold this card in reserve for the first Supreme Court nominee. I hope that Bush rams the two nominees, Myers and Saad, plus Brett M. Kavanaugh and William J. Haynes down their throats in short order and forces the Dems to show their hand earlier than that. (db)
