Terri Schiavo Fate Rests with Federal Judge

The fate of Terri Schiavo is now in the hands of U.S. District Judge James Whittemore, who was nominated to the court in 1999 by President Clinton. An attorney for the Schindlers, Terri’s parents, has filed a motion for an emergency injunction to reinstate the feeding tube that was removed last Friday by order of Florida circuit judge George Greer.

The Save Terri Schiavo bill, having been passed unanimously by the Senate early yesterday, passed the House in a 203-58 vote during an emergency session, made necessary by two Democratic representatives that tried to derail the bill by requiring a voice vote that force lawmakers to cut their Easter vacations short and make hasty returns to Washington.

The editorial desk of the Los Angeles Times has lost no time in making its opinion know on the Schiavo legislation. In an unsigned editorial called The Midnight Coup they say:

Republican leaders, eyeing (sic) an opportunity to appease their radical right-wing constituents, convened Congress over the weekend to shamelessly interject the federal government into the wrenching Schiavo family dispute. They brushed aside our federalist system of government, which assigns the resolution of such disputes to state law, and state judges. Even President Bush flew back from his ranch to Washington on Sunday to be in on what amounts to a constitutional coup d’etat.

This case, headed like a bullet to the Supreme Court, must have most of the justices wishing for a Kevlar vest. The case is a marker for other battles — about medical assistance in ending a terminally ill life, as in the much-fought Oregon law and a similar proposal working its way through the California Legislature. About the rights of gay couples to assume spousal rights in medical decisions. Most painfully, about abortion.

I certainly do NOT agree with their positions on this legislation, but they are spot on about its significance in regards to future political fights. “Most painfully, about abortion”, shows what they are truly worried about. Way to go LATimes, once again you side with the Culture of Death over Right to Life. For the moment at least, “Life” has won a round. Let’s pray that Judge Whittemore allows Terri to have a shot at living and getting the treatment and therapy she has been denied by her husband Michael for over 13 years! (db)
